Reading Intervention Terms and Agreements
By signing below and enrolling a child in services, the parent or legal guardian acknowledges that they have read, understand, and agree to the following terms.
1. Independent Educational Practice
Erika McCullough Literacy is an independent private educational practice and is not affiliated with, sponsored by, or endorsed by any public or private school or school district.
All services are provided independently and separately from the provider’s employment with any school or school district.
2. Services
Erika McCullough Literacy provides individualized reading intervention, literacy consultation, and parent support based on Structured Literacy and Science of Reading principles.
Depending on the student’s needs and selected plan, services may include:
Individualized lesson planning
Live virtual intervention sessions
Progress monitoring
Instructional adjustments
Parent communication
Home-practice recommendations and resources
Services are educational in nature and are intended to supplement, not replace:
School instruction
Special education or dyslexia services
Formal educational or psychological evaluations
Speech-language therapy
Occupational therapy
Counseling, psychological, or medical care
Parents remain responsible for educational decisions regarding their child and for communicating with the child’s school and other providers.
3. Educational and Diagnostic Disclaimer
Erika McCullough Literacy does not diagnose dyslexia, ADHD, learning disabilities, speech or language disorders, psychological conditions, developmental conditions, or medical conditions.
Any literacy screening, instructional assessment, observation, or progress-monitoring information provided through the practice is educational and instructional in purpose and should not be interpreted as a formal diagnosis.
4. Enrollment Requirements
Enrollment is complete only after Erika McCullough Literacy has received:
A signed Service Agreement;
A completed Student Intake Form;
Any additional information reasonably required to begin services; and
The required subscription payment or recurring-payment authorization.
A recurring appointment may be held temporarily during enrollment but is not guaranteed until all enrollment requirements have been completed.
5. Monthly Subscription
Reading-intervention services are provided through a recurring monthly subscription.
The subscription:
Reserves the student’s recurring appointment time;
Covers the services included in the selected plan; and
Supports lesson preparation, instruction, progress monitoring, record keeping, instructional adjustments, and parent communication.
The subscription is not calculated solely according to the number of sessions occurring in a particular calendar month.
Subscription payments are billed on the first day of each month unless another written arrangement has been approved. Families beginning services after the first of the month may be charged a prorated amount or another agreed initial payment before regular monthly billing begins.
Erika McCullough Literacy may change subscription rates by providing at least 30 days’ written notice.
6. Recurring Payment Authorization
Subscription payments are processed through Square using a recurring invoice and the payment method authorized by the parent or guardian.
By saving a payment method and authorizing automatic payments, the cardholder authorizes Erika McCullough Literacy and Square to charge the amount due according to the monthly billing schedule until services are properly cancelled or terminated under this agreement.
The parent or guardian is responsible for:
Maintaining a valid payment method;
Keeping billing information current; and
Promptly resolving declined or failed payments.
Removing a payment method or cancelling payment authorization does not eliminate any outstanding balance or replace the required cancellation notice.
7. Failed or Late Payments
If a payment is declined or cannot be processed, the parent or guardian must update the payment method or resolve the balance promptly.
Services may be paused if payment remains outstanding. Erika McCullough Literacy may release the student’s recurring appointment if the balance is not resolved within five calendar days after written notice.
No late fee will be charged unless the amount and terms are disclosed in writing in advance.
8. Subscription Cancellation
Because recurring appointment times are reserved specifically for each student, at least 30 days’ written notice is required to discontinue services.
Cancellation requests must be submitted by email to:

If notice is received fewer than 30 days before the next billing date, the upcoming subscription payment will still be due, and services will remain available through that paid period.
Subscription payments are nonrefundable after a billing cycle begins, except when Erika McCullough Literacy determines that a refund or credit is appropriate.
Stopping attendance, removing a payment method, disputing a valid charge, or verbally stating an intention to discontinue does not replace the written-cancellation requirement.
9. Attendance and Participation
Consistent attendance and active participation support effective intervention.
Parents agree to:
Ensure the student attends sessions consistently and on time;
Provide a quiet and reasonably distraction-free learning environment;
Provide a working device and reliable internet connection;
Help the student log in when needed;
Encourage appropriate participation; and
Communicate relevant concerns or changes promptly.
Erika McCullough Literacy may recommend changes or discontinue services if repeated absences, limited participation, behavioral concerns, or environmental distractions prevent meaningful instruction.
10. Student Absences and Make-Up Sessions
Parents should notify Erika McCullough Literacy as soon as possible if a student cannot attend.
For cancellations made with at least 24 hours’ notice, one make-up opportunity may be offered when scheduling permits.
Make-up sessions:
Are not guaranteed;
Depend on provider availability;
May occur on a different day or time;
Must be completed within the timeframe provided; and
Have no cash value.
Sessions cancelled with fewer than 24 hours’ notice or missed without notice are forfeited and are not eligible for a refund, credit, or guaranteed make-up session.
Exceptions may be considered for emergencies at the provider’s discretion.
11. Late Arrival
Students who arrive late will receive the remaining portion of the scheduled session.
Sessions will end at the originally scheduled time. Late arrival does not qualify for a refund, credit, extension, or guaranteed make-up session.
12. Provider Cancellations
If Erika McCullough Literacy must cancel a session because of illness, emergency, technology failure, or another professional circumstance, the provider may offer:
A make-up session;
An alternative instructional activity;
An account credit; or
A prorated refund when another remedy is not reasonably available.
The appropriate remedy will be determined based on the circumstances and scheduling availability.
13. Planned Practice Closures
Families will receive notice of planned holidays and practice closures.
The monthly subscription reserves the student’s recurring appointment and is designed to remain consistent throughout the year. Subscription payments are therefore not ordinarily prorated for announced practice closures, and make-up sessions are not provided for those closures unless otherwise stated.
14. Schedule Changes
Recurring appointment times are established by mutual agreement and remain subject to provider availability.
Requests to change a recurring appointment are not guaranteed. Erika McCullough Literacy may occasionally need to adjust the schedule because of professional obligations, emergencies, enrollment changes, or operational needs. Reasonable notice will be provided whenever possible.
A family’s recurring appointment may not be transferred to another student without written approval.
15. Virtual Services and Technology
Services are delivered virtually through video-conferencing and digital instructional tools.
Parents acknowledge that:
Internet-based services may occasionally be interrupted;
No online system can be guaranteed to be completely free of privacy or security risks;
The family is responsible for providing a compatible device and reliable internet connection; and
The parent or guardian is responsible for supervising the child’s use of technology as appropriate.
If technology problems prevent meaningful instruction, Erika McCullough Literacy may reschedule the session, provide an alternative activity, or determine another reasonable solution.
Sessions may not be recorded by the family without advance written permission.
16. Parent and Guardian Responsibilities
Parents and guardians agree to:
Provide complete and accurate intake information;
Report significant educational, developmental, medical, behavioral, or scheduling changes relevant to services;
Communicate concerns promptly;
Participate in periodic progress discussions;
Review recommendations and progress information;
Support home practice when reasonably possible; and
Maintain respectful communication.
The enrolling adult confirms that they have the legal authority to enroll the child and consent to services.
If legal decision-making authority is shared, the enrolling adult is responsible for ensuring that enrollment and participation comply with any applicable custody orders or agreements.
17. Emergency Procedures
Erika McCullough Literacy does not provide emergency, crisis, medical, or mental-health services.
A parent, guardian, or designated responsible adult must remain reachable during each virtual session.
If an emergency appears to involve an immediate threat to the student’s health or safety, Erika McCullough Literacy may contact emergency services and then attempt to contact the parent, guardian, or emergency contact.
18. Student Records and Confidentiality
Student and family information will be treated as confidential and used only for purposes related to providing and administering services.
Records may include:
Intake information;
Service agreements;
Attendance records;
Screening or assessment information;
Instructional notes;
Progress-monitoring data;
Parent communications;
Reports; and
Billing records.
Reasonable safeguards will be used to protect these records. However, no electronic storage or communication system can be guaranteed to be completely secure.
Records will be retained according to the practice’s record-retention policy and applicable legal requirements and may then be securely destroyed.
Information will not ordinarily be shared with a school, evaluator, physician, therapist, or other third party without written parent authorization unless disclosure is required or permitted by law.
19. Communication
Routine communication will generally occur through email unless another method is arranged.
Parents acknowledge that ordinary email and text messages may not be completely secure and should avoid sending highly sensitive information through unsecured methods.
Routine messages are typically answered within two business days, excluding weekends, holidays, and planned closures.
Email and messaging are not monitored continuously and should not be used for emergencies.
20. Photographs, Recordings, Testimonials, and Publicity
Student names, identifying information, photographs, recordings, work samples, testimonials, or case information will not be used publicly without separate written consent from the parent or legal guardian.
Declining publicity consent will not affect eligibility for services.
21. Intellectual Property
Lesson plans, instructional materials, reports, digital resources, videos, and other original materials created or supplied by Erika McCullough Literacy remain the intellectual property of Erika McCullough Literacy or the applicable third-party rights holder.
Materials are provided for the enrolled student’s personal educational use only and may not be reproduced, resold, posted publicly, shared with other families or providers, or used commercially without written permission.
Parents may retain copies of reports or records prepared specifically for their child.
22. Progress and No Guarantee of Results
Reading development varies among students.
Progress may be influenced by attendance, frequency of services, student participation, learning profile, prior instruction, home practice, school programming, health, development, and other outside factors.
Erika McCullough Literacy does not guarantee a particular outcome, diagnosis, grade-level gain, test score, rate of progress, school placement, or completion timeline.
23. Collaboration With Schools and Other Professionals
At the parent’s request and with appropriate written authorization, Erika McCullough Literacy may communicate with a school or outside professional.
Collaboration beyond the services included in the selected plan may require a separate appointment or fee. Any additional fee will be disclosed before the service is provided.
Erika McCullough Literacy cannot guarantee that a school, district, evaluator, or other provider will accept or implement its observations or recommendations.
24. Termination of Services by the Provider
Erika McCullough Literacy may pause or discontinue services when:
Subscription payments remain unpaid;
Attendance or participation problems significantly interfere with instruction;
The student’s needs fall outside the provider’s scope of services;
The parent or student engages in threatening, abusive, discriminatory, or persistently disrespectful conduct;
The parent repeatedly violates this agreement;
Services are no longer appropriate or beneficial; or
Continued services become impracticable or unsafe.
When reasonably possible, notice will be provided and alternative resources may be recommended. Immediate termination may occur when necessary to protect safety, privacy, professional boundaries, or the integrity of the practice.
The family remains responsible for charges incurred before the termination date.
25. Events Beyond the Provider’s Control
Erika McCullough Literacy is not responsible for delays or inability to provide services caused by circumstances beyond reasonable control, including severe weather, widespread utility or internet outages, government action, natural disaster, illness outbreak, platform failure, or other emergency.
When practical, reasonable efforts will be made to communicate and offer an alternative arrangement.
26. Electronic Agreement
The parties agree that this agreement may be completed and signed electronically.
A typed name, checked acknowledgment box, electronic signature, or similar electronic action intended to indicate acceptance will have the same effect as a handwritten signature to the extent permitted by law.
27. Changes to This Agreement
Material changes affecting an enrolled family will be communicated in writing.
Except for subscription-rate changes addressed above, material updates will generally become effective after reasonable notice.
Changes to an individual family’s arrangement must be documented in writing.
28. Severability and Waiver
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
29. Governing Law
This agreement is governed by the laws of the State of Texas.
30. Entire Agreement
This agreement, together with the selected subscription plan and any written addendum, represents the complete agreement between Erika McCullough Literacy and the parent or guardian regarding recurring literacy-intervention services.
It supersedes prior verbal discussions, messages, or understandings concerning the same services.
Parent/Guardian Acknowledgments
By signing below, I acknowledge that:
I have read and understand this agreement.
I have had the opportunity to ask questions.
I have the legal authority to enroll the student.
I consent to the student’s participation in virtual educational services.
I understand the nature and limitations of the services.
I understand that no specific educational result is guaranteed.
I agree to the monthly subscription and recurring billing terms.
I authorize recurring payments through the payment method I place on file with Square.
I understand that at least 30 days’ written notice is required to discontinue services.
I understand that subscription payments are generally nonrefundable after a billing cycle begins.
I understand that enrollment is not complete until all required forms and payment arrangements have been received.
My student’s selected subscription plan, recurring appointment time, monthly subscription amount, and first billing date have been confirmed separately in writing. That written enrollment confirmation is incorporated into and forms part of this agreement.
